Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondents to establish a permanent Police out Post at District Court Campus, Madurai. ORDER
[Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to direct the respondents to establish a permanent Out-Post Police Station in District Court campus, Madurai, by way of issuing a Writ of Mandamus.
2.Mr.M.Govindan, learned Special Government Pleader, has taken notice for the respondents 1 to 3. Mr.D.Sivaraman, learned counsel has taken notice for the fourth respondent. 3.The petitioner, a practising Advocate, has vehemently contended to the effect that every day in District Court campus, Madurai, so many untoward incidents are happening and no effective steps have been taken so as to maintain peace and tranquillity in and around District Court campus. Under the said circumstances, it is very much essential to establish an Out-Post Police Station inside District Court campus and a representation dated 11.05.2017 has also been given to the Personal Assistant of the Principal District Judge, Madurai. So far no action has been taken. Therefore, the present Writ Petition has been filed for getting the relief sought therein.
4.The learned Special Government Pleader appearing for the respondents 1 to 3 has also equally contended to the effect that already sufficient number of police personnel are being deployed everyday in District Court campus so as to maintain peace and tranquillity and further Anna Nagar Police Station is situate just 100 meters away from District Court campus and therefore the present writ petition has been filed unnecessarily and the same deserves to be dismissed.
5.It is seen from the records that on 11.05.2017 a representation has been given to the Personal Assistant of the Principal District Judge, Madurai. Further, the entire control of District Court campus vests with the Principal District Judge, Madurai. Under the said circumstances, this Court is inclined to pass the following order.
6.In fine, this Writ Petition is allowed in part without costs. The Principal District Judge, Madurai is directed to look into the representation dated 11.05.2017 and take appropriate action, if necessary.
