O R D E R

Seeking speedy disposal of the case in CC No.81 of 2025, on the file of the Additional District and Sessions Court/EC Court, Pudukkottai, the petitioner/A1 in the above case, has approached this Court.

2.Mr.R.Meenakshi Sundaram, learned Additional Public Prosecutor takes notice for the respondent.

3.A case in Crime No.768 of 2024 has been registered for the offence under Sections 8(c) r/w 20(b) (ii) (c), 25, 291(1) and 25 of NDPS Act, as against this petitioner that he was in possession of 150 kg of ganja. The final report has been filed and taken on file in CC No.81 of 2025 only in the year 2025. The contraband involved in this case is of commercial quantity.

4.It is pertinent to refer to the decision of the Hon'ble Supreme Court in High Court Bar Association, Allahabad vs. State of Uttar Pradesh & Ors [(2024) 6 SCC 267], wherein it was held that the Constitutional Courts should refrain from fixing a time-bound schedule for the disposal of cases pending before any other Courts in the ordinary course and the issue of prioritizing the disposal of cases should be best left to the decision of the courts concerned where the cases are pending. The above decision was approved by the Hon'ble Supreme Court in Sangram Sadashiv Suryavanshi vs. State Of Maharashtra [2024 INSC 899] and it was observed that routinely issuing directions for time bound disposal without ascertaining the pendency of cases with the trial courts would adversely affect their functioning.

5. In view of the same, this Court is not inclined to grant relief to the petitioner, as prayed for. Accordingly, this Criminal Original petition is dismissed.
