Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents No.1 to 6 to remove the encroachments made by the respondent No.7 in the common Public Road in S.No.1388/1A, Thiruvenkadam Taluk, Tenkasi District in light of the communication issued by the 4th respondent in TGMTLK/421/2024-B1 dated 16.05.2024 within time stipulated by this Court. O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted seeking a direction to the respondents 1 to 6 to remove the encroachments made by the seventh respondent in the common public road in Survey No.1388/1A, Thiruvenkadam Taluk, Tenkasi District, in light of the communication issued

by the fourth respondent in TGMTLK/421/2024-B1 dated 16.05.2024 within time stipulated by this Court.

2. Learned counsel for the petitioner submitted that enforcement actions for removal of encroachments in the subject road have already been initiated; a writ petition was filed in W.P.(MD) No.17054 of 2024 challenging the notice issued under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, and the said writ petition was also dismissed by this Court vide order dated 24.06.2024 and therefore, there is no impediment for the authorities concerned for concluding the enforcement action.

3. In view of the above submission, the authorities concerned are directed to complete the enforcement action for removal of encroachments in the subject road in all respects and remove the encroachments in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above direction, this writ petition is disposed of. No

costs.
