For Respondent : Mr.B.Thanga Aranvindh Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.91 of 2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 147, 148, 450, 353, 307 and 506(ii) of IPC in Crime No.91 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant's friend one Guna was working with the brother of the petitioner, namely, Chinna Thambi. Due to salary dispute between them last year, the said Guna was murdered by Chinna Thambi and his brother Paramasivam. Due to the same, Chinna Thambi was murdered by the defacto complainant and his associates on 02.03.2023, owing to which, a case was registered against the defacto complainant and his friends at Dindigul Taluk Police Station. The defacto complainant and his friend Vignesh were also arrested in that regard. Since the defacto complainant and Vignesh sustained cut injuries on their hands, they were taken to Government Medical College Hospital, Virudhunagar for treatment on 22.03.2023. While so, the petitioner and the other accused persons entered the Hospital and scattered Chilli Powder on the faces of the Police and assaulted the defacto complainant and his friend with sickle and iron bar. CRL OP(MD). No.8712 of 2023 attack, the defacto complainant and his friend sustained grievous injuries. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is only the fifth accused and he is a cardiac patient.
4. The learned Government Advocate on instructions would submit that four previous cases of similar nature are pending against the petitioner.
5. Considering the facts and circumstances of the case, nature of offence and the fact that the petitioner has four previous cases of similar nature, this court is not inclined to grant anticipatory bail to the petitioner.
