Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the second respondent to survey the petitioner's land in S.F.No.10/1 situated in T.Vellalapatti Village, Melur Taluk, Madurai District, to an extent of 1 Acre and 31 Cents and issue patta by sub-dividing the same within the time stipulated by this Court.

By consent, the writ petition itself is taken up for final disposal.

2. The petitioner seeks issuance of a writ of Mandamus to consider his representation dated 12.06.2015 followed by reminder dated 15.02.2017 for measuring and demarcating his property and for issuance of patta. The petitioner claims to be the owner of the property in S.No.10/1 at T.Vellalapatti Village, Melur Taluk, Madurai District, having purchased the same under the registered sale deed dated 10.04.1952 and it appears that he sold 2 cents out of the total extent purchased by him.

Considering the limited relief sought for and the facts narrated above, without going into the merits, there will be a direction to the second respondent to consider the representation of the petitioner dated 15.02.2017 and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The second respondent shall also issue notice to any other person who is shown to be interested or whose name appears in the revenue records and hear them before passing any order. The petitioner shall also pay the required charges for survey and demarcation of his property as and when demanded by the second respondent.

4. Accordingly, this writ petition is disposed of as above. No costs.
