PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents 1 to 5 to take action against the private respondents 6 and 7 for excommunicating the petitioner and his family members and consequently, direct the respondents 1 to 5 to collect the temple tax from him and his family members for Kamatchi Amman Sakthi Temple Festival which is situated at Mayiloorani (Purakarai), R.S.Mangalam Taluk, Ramanathapuram District for worshipping and conducting regular Pooja, Vaigasi Karakam, Pal Sombu festival by considering the petitioner's representations dated 07.05.2024 and 02.06.2024 within a stipulated time that may be fixed by this Court. The petitioner, with a grievance that they are mot allowed to participate in the village temple festival, has approached this Court. 2.The learned counsel for the respondents 6 and 7 of the temple committee submits that they are not discriminating anybody and the petitioner can very well participate in the village festival. He further submits that the petitioner, who belongs to the adjacent village, has created problem in an earlier 2/5
occasion and also attempted to take away the holy box and therefore, they are having some apprehension.
3.The learned counsel for the petitioner submits that the festival committee has refused to collect temple tax from the petitioner's family, since they have been excommunicated from participating in the temple festival. However, he further submits that the petitioner undertakes that he will not create any such problem in the present temple festival. 4.On the suggestions made by this Court, the learned counsel for the respondents 6 and 7 submits that the respondents 6 and 7 are also willing to receive the temple tax from the petitioner and allow him to participate in the village festival.
5.Recording the submissions of the learned counsel for the respondents 6 and 7, this Writ Petition is closed. No costs. Index :Yes/No 11.06.2024 Internet : Yes/No sedgy 3/5
