Mr.T.Amjad Khan, learned Government Advocate takes notice for the first respondent.
2. The petitioner school has filed this writ petition aggrieved by the order of deployment, deploying one Post of B.T. Assistant(Mathematics) on the ground that it is surplus.
3. The learned counsel for the petitioner submitted that the petitioner school has got enough students strength and therefore, one post of B.T. Assistant (Mathematics) is very much essential and even as per Rules, the petitioner school is entitled to get sanction for one post of B.T. Assistant(Mathematics).
4. However, the learned Government Advocate submitted that if the petitioner school makes a request, then the first respondent shall consider the same and re-fix the staff strength for the year 2024-2025. 2/5
5. In the meanwhile, if the deployment order is given effect to, that will affect the interest of the school, students and the Teacher who is likely to be deployed to some other school.
6. Since the petitioner school has given a representation to the first respondent on 28.05.2024, the first respondent shall consider the representation of the petitioner school in the light of the above observations made, within a period of four weeks from the date of receipt of a copy of this order. Before that, the first respondent shall not resort to any deployment procedure in respect of the above said Post till the disposal of the representation of the petitioner's school.
7. With the above directions, this writ petition stands disposed of. No Costs. Consequently, connected Miscellaneous Petition is closed. 07.06.2024 NCC: Yes/No Index : Yes/No PM 3/5
