This Writ Petition is filed for issuance of Writ of Mandamus directing the respondent to depute a Surveyor to measure and survey the property comprised in Survey No.134/1A 1A situated at Keelakottai Village, Sinnalpatti, Athoor Taluk, Dindigul District, on the basis of the petitioner's representation, dated 10.05.2017.
2. The case of the petitioner is that he became the absolute owner of the property to an extent of 950 sqft in Survey No.134/1A 1A by virtue of a sale deed dated 28.03.2013, registered as document No.996/2013. Due to error in old Survey Number, a rectification deed was also registered on 17.07.2013. Thereafter, the petitioner submitted an application on 20.06.2014 for issuance of patta and it was issued in favour of the petitioner.
3. The petitioner would further submit that on 10.05.2017, he made an application to the respondent, after payment of necessary fees, to measure and survey the property and fix the boundary https://hcservices.ecourts.gov.in/hcservices/
stones. Since no action was taken, the present Writ Petition is filed.
4. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate appearing for the respondent and perused the materials available on record.
5. Considering the limited prayer sought for in this Writ Petition, this Court, without going into the merits of the case, directs the respondent to consider the application of the petitioner dated 10.05.2017 and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order, after providing opportunity to all the necessary parties.
6. With the above directions, this Writ Petition is disposed of. No costs.
