Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent.
2. The petitioner has submitted an application seeking issuance of passport. His request was negatived on the ground that as per police verification report, a criminal case is pending against him. The respondent will obtain clarification from the concerned authority, if the case is still pending at the FIR stage or it has culminated as a Calendar Case. If the case is pending only at the FIR stage then, it shall not operate as a disqualification and the respondent shall process the petitioner's application and issue passport subject to fulfilment of the other usual formalities. If the case is ended in Calender Case, the petitioner will have to move the jurisdictional Magistrate Court.
3. With this direction to the respondent, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
