Petition filed under Article 226 of the Constitution of India, for issue of Writ of Mandamus, directing the respondents to consider the representations dated 07.06.2021 and 21.06.2021 submitted to the respondents seeking promotion to the post of Sanitary Supervisor in 3rd respondent Town Panchayat, within a time limit that may be fixed by this Court.

By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

2. According to the petitioner, he was working as Sanitary Worker in the respondent town panchayat with effect from 1.02.1999 and he was regularized with effect from 1.02.2002. Thereafter, the petitioner made a representation to the third respondent to consider him for promotion to the post of Sanitary Supervisor in the vacant place. But till date, the said representation is pending, and no https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.13630 of 2021 orders were passed. Hence the petitioner has filed the present Writ Petition.

3. The learned counsel appearing for the respondents agreed that if such a representation is pending, it shall be considered and orders will be passed in accordance with law.

4. In view of the above submissions of the parties, without expressing any opinion on merits, this court is inclined to direct the third respondent to consider the petitioner's representation dated 07.06.2021 on its own merits and in accordance with law and pass orders within a period of 8 weeks from the date of receipt of a copy of this order.

5. With the above directions, the Writ Petition is disposed of. No costs.
