PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the first respondent to grant permission for planting a Tamilaga Vettri Kalam (TVK) Party flag at a height of 60 feet on the property comprised in Survey No.2/3, to an extent of 1 pit (33 cents), situated at Pudhukottai Ullur Village, Pattukottai Taluk, Tanjore District, and consequently direct the fourth respondent to provide police protection at the time of installing the flag, based on the petitioner representation dated 20.03.2025.

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the first respondent to grant permission for planting a Tamilaga Vettri Kalam (TVK) Party flag at a height of 60 feet on the property comprised in Survey No.2/3, to an extent of 1 pit (33 cents), situated at Pudhukottai Ullur Village, Pattukottai Taluk, Tanjore District, and consequently to direct the fourth respondent to provide police protection at the time of installing the flag, based on the petitioner's representation dated 20.03.2025. 2/5
2. The learned Special Government Pleader, on instructions, submitted that erecting a flagpole of 60 feet height is not possible due to safety concerns, as a TANGEDCO electricity pole carrying a 11 KV line located within 5 feet from the disputed site. Therefore, the permission cannot be granted.
3. After hearing the rival submissions, this Court is of the considered opinion that, initially the respondents may consider for erecting the said pole within the safety limit. In case, if the petitioner requires a height over and above the safety distance of the pole, then the petitioner is at liberty to approach the Tamil Nadu Electricity Board to realign the 11 KV line under the DCW scheme, by paying appropriate amount. If such realignment is effected, the petitioner is at liberty to approach the respondents again for erecting the flagpole. If any alternative place is suggested by the petitioner, the respondents may consider the same in accordance with law including safety requirements.
4. With the above said directions, this Writ Petition is disposed of. There shall be no order as to costs.
