ORDER

This criminal original petition is filed to direct the 1st respondent to transfer the investigation in Crime No.437 of 2025 dated 21.12.2025 from the 3rd respondent to 6th respondent.

2.With respect to the death of the petitioner's husband in a road accident, F.I.R in Crime No.437 of 2024 was registered on the file of the 3rd respondent police on 21.12.2024. Since there was no progress in the investigation, this petitioner has come before this Court.

3. When the matter is taken up for hearing, the learned Government Advocate(Crl.Side) submitted that already the matter has been closed as 'undetected'.

4. For which, the learned counsel for the petitioner submitted that in view of the above, protest petition was filed before the learned trial court, in which the learned trial Court has passed an order directing the 3rd respondent to 2/6

conduct further investigation in Crl.M.P.No.1109 of 2025 in Judicial Magistrate No.II, Sivagangai. However, the said order was not complied by the 3rd respondent police. The accident occurred solely due to the negligence of the road contractor, who had recklessly placed building materials in the middle of the road. The same was recorded by the learned Judicial Magistrate and only thereafter, directed the 3rd respondent to conduct further investigation.

5. The learned Government Advocate(Crl.Side fairly conceded that further investigation would be conducted and the matter will be looked into.

6. Heard the learned counsel on either side and carefully perused the materials available on record.

7. In view of the submission made by either parties, the 3rd respondent is directed to conclude the investigation as expeditiously as possible within a period of four (4) weeks from the date of receipt of copy of this order and further directed to apprise the progress in the investigation to the 1st respondent. The 1st respondent is directed to monitor the investigation conducted by the 3rd respondent.

8. With the above directions, this Criminal Original Petition stands disposed of.
