9712 of 2015 dated 16.06.2015 ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.SUBAHARAN Advocate for M/S.M.DANIEL MANOHARAN, Advocate for the petitioner and of MR.V.PANDI Government Advocate for the Respondent No.2 and first Respondent not appeared either in person or by an Advocate the court made the following order:- This petition is only to withdraw the amount which is lying to the credit of the Labour Court, Tirunelveli, pursuant to the deposit by the first respondent as per the order passed by this Court earlier in W.M.P.(MD) No. 1 of 2015 in W.P.(MD) No.9712 of 2015. The petitioner states that the amount which is lying is only 25% of amount awarded by the labour Court.

Hence, the petitioner is permitted to withdraw the 25% of the amount which was awarded by the Labour Court and lying to the credit of the proceedings as per the direction of this Court in W.M.P.(MD) No. 1 of 2015 in W.P.(MD) No.9712 of 2015.

2.The learned counsel for the petitioner under instructions undertakes to reimburse the amount, in case, this Court allows the Writ Petition or set aside the award of the Labour Court in https://hcservices.ecourts.gov.in/hcservices/

entirety. The petitioner is also directed to file an affidavit of undertaking before the Labour Court.
