Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, to issue a direction directing the respondent to file a final report in Cr.No.277 of 2018 dated 27.10.2018 on the file of the respondent police U/s.147, 294(b), 323, 506(i) IPC r/w 3(1) of the TNPPDL Act within the time stipulated by this Court. ORDER
The defacto complainant in Crime No.277 of 2018 has filed this petition seeking a direction to the respondent police to file a final report in Crime No.277 of 2018 within a stipulated time. 1/4
2.The learned Counsel for the petitioner submits that though the case was registered in the year 2018, the respondent police have not conducted the investigation and filed the final report, whereas in the counter case, which has been registered in Crime No.276 of 2018, final report has already been filed.
3.The learned Government Advocate confirmed the submission of the petitioner.
4.This court considering the rival submissions made, called for a report from the Inspector General of Police.
5.Accordingly, the Inspector General of Police, Central Zone, Trichy has filed a report admitting that there was some lapses in the investigation for which necessary disciplinary proceedings have been initiated against the erring officials. He also placed on record the manner in which the Superintendent of Police, Thanjavur has conducted a drive from 24.01.2024 to 30.06.2025 and as a result, out of 1329 cases registered,975 cases were charge sheeted and otherwise disposed of in Ammapettai police station. He further states that the final report in Crime 2/4
No.277 of 2018 was already filed and also taken on file in CC.No.95 of 2025 on the file of the Judicial Magistrate Court, Papanasam on 01.07.2025. The final report was filed in the counter case in Crime NO. 276 of 2018 also and the same is pending in SC.No.174 of 2025 on the file of the District Sessions Court, Kumbakonam. He claims that though the cases were simultaneously investigated, final report in Crime No.277 of 2018 was filed belatedly on 26.06.2025 in contrary to PSO No.566. 6.Accepting the report of the Inspector of General of Police that final report has already been filed and also taken on file and by placing appreciation for the steps taken by the police, this petition is closed. 25.07.2025 DSK To 1.The Inspector of Police, Ammampettai Police Station, Thanjavur District.
