Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 05.06.2017 and dispose of the same in accordance with law.

ORDER

The petitioner has come up with the Writ Petition for issuance of a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 05.06.2017 and dispose of the same in accordance with law.

2.Heard Mr.V.Singan, the learned counsel appearing for the petitioner and Mr.D.Muruganandham, Additional Government Pleader appearing for the respondents, and perused the materials available on record.

3.The case of the petitioner is that the property to an extent of 0.04.05 hectares in Survey No.47/1A new survey No. 47/9 was originally owned by his grand father by virtue of two registered sale deeds dated 20.01.1993 and 24.01.1933. only legal heir had succeeded to property and has been possession of the property. The petitioner would allege that during Survery, the property of the petitioner was classified as a pathway. To rectify the mistake, he gave representation to the respondents on 05.06.2017. Since they have not taken any action, the present Writ Petition is filed.

4.Considering the facts and circumstance of the case and the prayer sought in the Writ Petition, this Court without going to the merits of the case, directed to the petitioner give one more representation to the second respondent within a period of two weeks from the date of receipt of copy of this order, by enclosing this order copy. On such compliance, the second respondent is directed to consider the representation and pass order on merits and in accordance with law, after providing necessary opportunity to the parties, with in a period of eight weeks there from. 5.With the above direction, the Writ Petition is disposed of. No costs.
