PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.208 of 2023 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/first accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 229(A) IPC, in Crime No.208 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner alleged to have involved in Crime No.55 of 2023 on the file of Thuvarankurichi Police Station for the offences under Sections 147, 148, 294(b), 323 and 307 IPC r/w Section 25(1A) of Arms Act and in that case, anticipatory bail was granted to the petitioner in Crl.M.P.No.1216 of 2023 on the file of the Principal District and Sessions Court, Trichy dated 17.03.2023 by imposing certain conditions. Thereafter, the petitioner had executed the surety before the concerned Court, but since he failed to comply with the condition, the present FIR came to be registered. https://www.mhc.tn.gov.in/judis 1/2

3. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondent would submit that the offence is bailable in nature.

4. In view of the submission made by the learned Government Advocate (Criminal Side), this Criminal Original Petition is dismissed.
