Heard both sides.
2. The petitioner alleges that the petition-mentioned survey numbers have been encroached. The learned Special Government Pleader clarified that survey No.169 has been classified as unassessed waste. He also stated that survey No.170 had already been sub-divided and it had been classified as Ryotwari punjai in the revenue records. However, in survey No.170/5, 170/6 and 170/8 Nilaviyal Odai is flowing there. The petitioner would allege that it had been blocked by dumping sand. We direct the official respondents to ensure that Nilaviyal Odai is maintained as such without there being any blockade.
3. With this direction to the respondents, this writ petition stands disposed of. No costs.
