Prayer : Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the 2nd respondent to complete the enquiry against the respondents 4 to 6 based on the petitioner's wife's complaint dated 11.12.2023 and consequently, take the appropriate legal action against the respondents 4 to 6.

ORDER

The petitioner has moved this petition, seeking a direction to the respondent Police to take action on his wife's complaint dated 11.12.2023.

2. The learned counsel for the petitioner submits that the petitioner has received some money from the private respondents, for which, he has created a document of his property as security. The property worth about crore rupees has been taken away by parting with a meager amount. 2/5

Therefore, the petitioner's wife has lodged a complaint before the respondent Police on 11.12.2023 and the same was not considered by the respondent Police. Therefore, the petitioner is before this Court.

3. The learned Government Advocate (Crl. Side) submits that the complaint dated 11.12.2023 was lodged only by the petitioner's wife and the same was enquired by the respondent Police and they found that there is a civil dispute between the petitioner's wife and the 4th respondent and a civil suit is also pending between the parties in O.S.No.2 of 2024. Therefore, they have closed the complaint on 08.03.2024. He further submits that the petitioner's daughter has lodged a complaint as against the 4th respondent for the offence punishable under the provisions of POCSO Act and the same has been registered in Crime No.15 of 2025. That apart, the petitioner's wife again lodged a complaint as against the 4th respondent on 20.06.2025 and the same was registered in Crime No. 22 of 2025.

4. In view of the submissions made by the learned Government Advocate (Crl. Side) that the complaint lodged by the petitioner's wife 3/5

dated 11.12.2023 was enquired by the respondent police and the same was closed on 08.03.2024, this Criminal Original Petition is closed with a direction to the respondent Police to furnish a copy of the closure report dated 08.03.2024 to the petitioner enabling him to workout his remedy in the manner known to law.
