ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 341, 294(b), 324 and 506(2) of IPC, seeks anticipatory bail.

2. The case of the prosecution is that on 08.07.2021, the petitioner has assaulted the defacto complainant, abused him in filthy language and criminally intimidated him. Hence, the complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he is falsely implicated in this case.

4. The learned Government Advocate (Criminal Side), on instructions, would submit that on earlier occasion, the petitioner had assaulted the defacto complainant in this case, on account of which, a case is already registered against him. When the other case is pending, the petitioner assaulted the defacto complainant once again, and hence, this case came to be registered. Considering the bad antecedent of this petitioner, this Court by earlier order dated 15.07.2021 in Crl.OP(MD)No.9311 of 2021 dismissed the application for anticipatory bail.

5. This is the second anticipatory bail application. There is no change of circumstance and hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
