PRAYER :- For Bail in Crime No.57 of 2024 on the file of the respondent police. ORDER : The Court made the following order :- The respondent police registered a case as against this petitioner in Crime No.57 of 2024 for the offence under Section 8(c) r/w. Section 22(C) and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and remanded him into judicial custody on 18.02.2024. Therefore, the petitioner has filed this petition seeking bail. 1/3

2. The case of the prosecution is that the petitioner and other accused were found in joint possession of 55 grams of Magic Mushroom.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he is languishing in Jail from 18.02.2024. He further submits that the contraband has been recovered only from A1 and not from the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent submits that on seeing the police party, the petitioner/A2 ran away from the place of occurrence and the accused were arrested with contraband and the same was recovered, which is a commercial quantity and the investigation is in crucial stage.

5. Considering the nature of allegation and also considering the fact that the investigation is crucial stage and the petitioner is arrested along with A1, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. The respondent police shall find out the connection of the petitioner with A1. sd/- 18/06/2024 / TRUE COPY / /07/2024 Sub-Assistant Registrar (C.S. I / II / III / IV ) Madurai Bench of Madras High Court, Madurai - 625 023.
