ORDER
This writ petition has been filed seeking writ of Mandamus directing the 2nd Respondent to consider and pass orders on the petitioner's representation dated 03.01.2026 in light of the proceedings of the 1st respondent in Na.Ka.No.COOP/1173/2025Poo3 dated 29.07.2025. 2.The petitioner who served as a Secretary in the 3rd respondent society retired from service on attaining the age of superannuation as early as on 30.05.2023. However, his terminal 2/7
benefits have not been settled as on date, purportedly, on the ground that the petitioner has suffered a surcharge order under Section 87 of the Tamil Nadu Co-operative Societies Act, 1983 and under which huge amount is due and payable to the 3rd respondent Society.

Learned counsel for the petitioner submitted that the said surcharge orders dated 13.05.2014 & 16.07.2014 that are passed against the petitioner are not against the petitioner alone, but they were passed against several other individuals as well fixing joint and several liability. He also further submitted that in respect of the other employees, who are also co-employees who suffered the surcharge orders have approached the respondents for disbursal of the terminal benefits and the same was considered by the 1st respondent herein and accordingly, issued orders in letter No.COOP/1173/2025/pa.vu3, dated 29.07.2025 and in the light of the same, the petitioner also submitted a representation dated 03.01.2026 requesting for passing an identical order in respect of the petitioner also. But the said representation is still pending for consideration, no action has been taken by the respondents.

According to the learned counsel for the petitioner, the petitioner herein as well as the beneficiary of the said proceedings dated 29.07.2025, namely, Tmt.R.Nagavalli, then Co-operative Sub Registrar / Field Officer are similarly placed and therefore, the petitioner is also entitled for an identical entitlement.

Mr.S.Shaji Bino, learned Special Government Pleader appearing for respondents 1 & 2 fairly submitted that the respondents No.1 is the competent authority and the proceedings dated 29.07.2025 also has been issued by the first respondent alone, but the petitioner has submitted representation only before the second respondent and hence, he submitted that in case, if any representation is submitted to the first respondent, the same would be considered by him in accordance with law.
5. Mr.S.Kumar, learned counsel appearing for 3rd respondent also submitted that the petitioner may be directed to approach the first respondent.

In the light of the above, without going into the merits of the matter, the writ petition is disposed of granting liberty to the petitioner to submit a representation within a period of three weeks from the date of receipt of a copy of this order before the first respondent and in case, if any such representation is submitted by the petitioner within the time stipulated above, the first respondent shall consider the same duly taking into consideration the relief granted in favour of Tmt.R.Nagavalli, the then Co-operative Sub Registrar/Field Officer through letter No.COOP/1173/2025/pa.vu3, dated 29.07.2025 and pass appropriate orders, thereon, as expeditiously as possible, at any rate within a period of eight (8) weeks from the date of submission of representation by the petitioner. No costs.
