For Respondent : Mr.M.Vaikkal Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Bail in Crime No.13 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/1st accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 498(A) and 494 I.P.C and Section 4 of TNPHW Act, in Crime No.13 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.When the matter was taken up for hearing on 24.06.2022, it was brought to the notice of this Court that suppressing the filing of this petition, the accused person filed an application before the concerned Sessions Court seeking anticipatory bail. It was also brought to my notice on the previous occasion that a case was registered against the petitioner based upon the complaint made by the defacto complainant. This is the second case in sequence. 3.The victim girl is also present before this Court along with her parents and she has submitted that because of the continuous torture that was made by this petitioner to marry her sister, trouble has arisen between them. CRL OP(MD). No.11297 of 2022 other person and later, the petitioner married another girl and now, they are settled in Coimbatore and the defacto complainant is having two children also.

4.Considering this pathetic situation, the petitioner must workout compromise, even though he has been released on bail by the concerned Sessions Court on 28.06.2022. The respondent may also take steps to cancel the bail that was granted to this petitioner by the Sessions Court on the ground of suppression of facts. 5.With the aforesaid direction, this Criminal Original Petition is disposed of.
