ORDER
The Criminal Original Petition has been filed to set aside the para No.6 of the order made in Crl.M.P.No.163 of 2023 dated 10.05.2023 on the file of the Court of the learned Sessions Judge (Vacation), Theni, insofar as permitting the defacto complainant to withdraw the amount and thereby extend the time to deposit the amount.
2. The learned counsel appearing for the petitioner seeks modification of the para No.6 of the order passed in Crl.M.P.No.163 of 2023 dated 10.05.2023.
3. Heard the learned counsel appearing for the petitioner, the learned counsel appearing for the intervenor and the learned Government Advocate appearing for the respondent.
4. The learned Sessions Judge (Vacation), Theni, granted bail to the petitioner herein vide order dated 10.05.2023 passed in Crl.M.P.No. 163 of 2023, in which, it is stated in para 6 that as per the memo filed by 2/4
the petitioner herein, the petitioner was permitted to deposit a sum of Rs.18 Lakhs to the credit of the concerned crime number and the defacto complainant was permitted to withdraw the same and the amount should be deposited on or before 16.05.2023.
5. Considering the facts and circumstances of the case, this Court is not inclined to entertain this petition and accordingly, this Criminal Original Petition is dismissed. However, three weeks time is granted to comply with the order passed by the learned Sessions Judge (Vacation), Theni, in Crl.M.P.No.163 of 2023 dated 10.05.2023. 17.05.2023 NCC :Yes/No Index:Yes/No Sm 3/4
