ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.18 of 2024, for the offence punishable under Sections 5(1) r/w Sections 6, 7 and 8 of POCSO Act of 2012, has filed this petition seeking anticipatory bail.
2. The case of the prosecution is that the defacto complainant and the petitioner are relatives and it is a love affair. The petitioner had forcible sexual intercourse with the victim girl. Hence, the case.
3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent Police raised serious objection stating that A2 is friend of A1. Al not only had forcible sexual intercourse with the victim girl, he also allowed A2 to abuse her.
5. Considering the facts and circumstances of the case and also considering the 2/3
nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is ordered and the petitioner is dismissed.
