Writ petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first respondent to dispose of the representation of the petitioner dated 17.05.2017 in terms of G.O.Ms.No.124 Personnel and Administrative Reforms (Per. N.) Department dated 22.02.1983 and Personnel and Administrative Reforms (N) Department Letter (Ms).No.321 dated 12.08.2004.

O R D E R

This Writ Petition has been filed by the petitioner for issuance of a Writ of Mandamus, directing the first respondent to dispose of the representation of the petitioner dated 17.05.2017 in terms of G.O.Ms.No.124 Personnel and Administrative Reforms (Per. N.) Department dated 22.02.1983 and Personnel and Administrative Reforms (N) Department Letter (Ms).No.321 dated 12.08.2004.

2. Mr.C.Selvaraj, learned Special Government Pleader takes notice for the first respondent.

3. By consent the Writ Petition itself is taken up for final disposal.

4. Though the Writ Petition is for issuing a Writ of Mandamus to give a positive direction to the first respondent, the learned counsel for the petitioner submit that the petitioner will be satisfied if a direction is issued to the first respondent, to consider the representation of the petitioner, dated 17.05.2017.

5. Having regard to the limited scope of the prayer and without going into the applicability of the Government Order and the Government Letter, as it has been construed by the petitioner in the present Writ Petition, this Court is inclined to issue the following direction:

"The first respondent is directed to consider the representation of the petitioner dated 17.05.2017, taking into account of the Government Order vide G.O.Ms.No.124 Personnel and Administrative Reforms (Per. N.) Department, dated 22.02.1983 and the Government Letter dated 12.08.2004, Personnel and Administrative Reforms (N) Department Letter (Ms). No.321, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order."

6. With the above direction, the Writ Petition is disposed of. No costs.
