RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the above said condition as Para No.5, "the petitioners are ordered to be released on bail on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) each with two blood related sureties, each for a like sum to the satisfaction of learned Additional District Judge, Special Court for under Essential Commodities Act, Thanjavur"as per order dated 21.04.2023 in Crl.OP (MD).7485/2023 on the file of this Hon'ble Court. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KARUNAKARAN K M, Advocate for the petitioner and of Mr.R.SIVAKUMAR, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition imposed by this Court in Para No.5 of the order passed in CRL.O.P.(MD)No.7485 of 2023 dated 21.04.2023.
2. This Court, on 21.04.2023, in CRL.O.P.(MD)No.7485 of 2023, granted bail stating that the petitioners are ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two blood related sureties, each for a like sum to the satisfaction of learned Additional District Judge, Special Court for under Essential Commodities Act, Thanjavur and on further conditions.
3. The learned counsel appearing for the petitioner submitted that the petitioner was unable to produce the blood sureties, since https://www.mhc.tn.gov.in/judis 1/2
CRL MP(MD) No.7428 of 2023 they do not have any property in their names. Hence, the sureties may be modified.
4. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondent.
5. Considering the request made by the learned counsel appearing for the petitioner, the condition imposed by this Court in Para No.5 of the order passed in CRL.O.P.(MD)No.7485 of 2023 dated 21.04.2023 is modified as follows:
"5. Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two family members as sureties, each for a like sum to the satisfaction of learned Additional District Judge, Special Court for under Essential Commodities Act, Thanjavur and on further conditions that:-"
6. Except this portion, other conditions imposed by this Court, in CRL.O.P.(MD)No.7485 of 2023 dated 21.04.2023 shall remain unaltered. This Criminal Miscellaneous Petition is allowed accordingly.
