PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents No.1 and 2 herein to take appropriate action against the respondents 3 and 4 on the basis of the petitioner's complaint dated 13.03.2022 within a stipulated time period in accordance with law. O R D E R

This Writ Petition has been filed seeking for issuance of a Writ of Mandamus, directing the respondents No.1 and 2 herein to take appropriate action against the respondents 3 and 4 on the basis of the petitioner's complaint dated 13.03.2022 within a stipulated time period in accordance with law.

2. The case of the prosecution is that the 4th respondent, who is an influenced person with the help of the 3rd respondent who is working as a Teacher in Government Higher Secondary School, Perumaruthur, Pudhukottai District, have brain washed the petitioner herein by saying that if he pays Rs.3,50,000/- they will arranged Government Job for him. Believing their words, the petitioner paid this amount to the third respondent in the presence of fourth respondents. After receiving amount they neither arranged job nor repaid the amount. Therefore, the petitioner gave a complaint to the respondent police. The respondent police did not take any action, hence this petition has been filed. 2/5

When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondents No. 1 and 2 submitted that already petitioner gave a complaint on 13.03.2022, when it was enquired, the dispute between the petitioner and the respondents 3 and 4 were amicably settled and the respondents 3 and 4 agreed to pay the balance amount to the petitioner and if the respondents 3 and 4 fail to pay the said amount, the respondent police shall proceed the matter in accordance with law.

4. In view of the same, the respondents 3 and 4 are directed to pay the balance amount to the petitioner as agreed and if they failed to do so, the second respondent is directed to consider the petitioner's representation dated 13.03.2022, and to take appropriate legal action in the manner known to law.

5. With the above said direction, this Writ Petition is disposed of. No costs.
