This Civil Miscellaneous Petition filed under Section 151 of C.P.C., praying to permit the petitioners 2 and 3 to withdraw 50% of the award amount of their respective share, which is lying to the credit of MCOP.No.68 of 2018 on the file of the Motor Accident Claims Tribunal/Principal Sub Court, Srivilliputhur.

ORDER

The above petition has been filed seeking orders to permit the petitioners 2 and 3 to withdraw 50% of the award amount of their respective share, which is lying 1/3

to the credit of MCOP.No.68 of 2018 on the file of the Motor Accident Claims Tribunal/Principal Sub Court, Srivilliputhur.

2. When the matter is taken up for hearing today, the learned counsel for the petitioners/claimants would submit that though the appellant has deposited 50% of the award amount in pursuance of directions of this Court and seeks permission to withdraw the amount.

3.The learned counsel for the appellant would submit that the appeal itself may be taken up for final hearing.

4. Considering the facts and circumstances of the case and also the submisssions made by the learned counsel on either side, this Court is inclined to grant permission. Accordingly, the petitioners are permitted to withdraw 50% of the amount that was deposited by the appellant, by filing necessary application before the Tribunal.
