Karthik P v. The District Collector
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 29.04.2025
CORAM
THE HONOURABLE MR.JUSTICE P.B.BALAJI P.Karthik ... Petitioner Vs.
1.The District Collector, Sivagangai.
2.The Revenue Divisional Officer, Sivagangai.
3.The Tahsildar, Manamadurai Taluk, Sivagangai.
... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to conduct enquiry based on the petitioner's representation dated 13.02.2025 and pass orders granting Natham Patta in favour of the petitioner for the house site to an extent of 3 cents situated in S.No.82/96 at Malavarayanendal, Manamadurai Taluk, Sivagangai District after affording an opportunity to the petitioner in accordance with law, within the time frame to be fixed by this Court. For Petitioner :
Mr.V.Karthick Raja For Respondents :
Mrs.S.Jeyapriya Government Advocate 1/4
O R D E R
Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.
2. The learned counsel for the petitioner would fairly bring to my notice that though representations were given in November 2024, survey number was wrongly mentioned and therefore, on 12.02.2025, during the General Grievance Camp programme, the petitioner has addressed a representation to the 1st respondent in person. The petitioner seeks disposal of the said representation, dated 12.02.2025. Admittedly, the said representation has been given only to the Collector and the competent authority is the Revenue Divisional Officer, Sivagangai considering the extent in respect of which the assignment patta is sought for by the petitioner.
3. In the light of the above, the petitioner is directed to make a fresh representation to the 2nd respondent enclosing relevant documentary evidence in support of long and continuous possession and enjoyment of the subject lands entitling to the petitioner to free house site patta. On such application being filed by the petitioner within a period of two (2) weeks from the date of receipt 2/4
of copy of this order, the 2nd respondent is directed to conduct due enquiry and pass final orders on the petitioner's entitlement for issuance of patta and if the petitioner is found to be entitled to such patta, necessary directions shall be issued to the 3rd respondent, within a period of twelve (12) weeks from the date of application being filed by the petitioner.
4. With the above directions, this Writ Petition stands disposed of. No costs.
