For Respondent : Mr.G.Ganesh Kumar Government Advocate(Crl.Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Cr.No. 12 of 2025 on the file of the respondent police. ORDER : The Court made the following order :- 1/6
The petitioners / A2 to A4, who were arrested and remanded to judicial custody on 08.10.2025 for the offences punishable under Sections 8(c),22(c),25,27A,28 and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.12 of 2025 on the file of the respondent, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused manufactured banned narcotic substance Mephedrone along with other accused believing that it would yield high profits. Hence the case.
3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent a false case has been foisted against them. He would further submit that the petitioners have been arrested and remanded to judicial custody on 08.10.2025. He would further submit that the second and third petitioners/ A3 and A4 were granted bail by the Sessions Court. Hence, he prays to grant bail to the petitioner. 2/6

The learned Government Advocate(Crl.Side) appearing for the respondent strongly opposed to grant bail to the petitioner on the ground that the quantity involved in this case is a commercial quantity. He would further submit that investigation is pending. He would further submit the second and third petitioners were granted bail by the Sessions Court.
5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, nature of offence, and though the prosecution stated that the contraband involved in this case is a commercial quantity no contraband was produced and further the first petitioner is employed under A1 and already similarly placed accused persons were granted bail and the fact that no previous case is pending against the first petitioner and also considering the period of incarceration undergone by the first petitioner this Court is inclined to grant bail to the first petitioner subject to the following conditions, 3/6
[a] Accordingly, the first petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Special Court under Essential Commodities Act, Thanjavur and on further conditions that:
[b] the first petitioner shall report before the trial Court daily at 10.30 a.m., until further orders.
[c] the first petitioner shall not commit any offence similar to the offence of which he is accused, or suspected, or of the commission of which he is suspected;
[d] the first petitioner shall not abscond either during investigation or trial;
[e] the first petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence;

[f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the first petitioner in accordance with law as if the conditions have been imposed and the first petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the first petitioner thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
7. As regard the second and third petitioner the petition stands dismissed.
