PRAYER :- For Bail in Crime No.101 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/ A2, who was arrested and remanded judicial custody on 21.03.2023 for the offences punishable under Sections 147,148,341,294(b),307 and 302 of IPC in Crime No.101 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that due to previous motive all the accused persons conspired together and committed the murder of the deceased. Hence the case came to be registered. 3.The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner was not present in the scene of occurrence. He further submits that the petitioner is in judicial custody from 21.03.2023, hence he seeks bail.

CRL OP(MD). No.8796 of 2023 4.The learned Additional Public Prosecutor would submit that the investigation is still pending. Further two previous cases are pending against the petitioner, of which one case is under section 302 of IPC, hence he objected to grant bail to the petitioner. 5.Taking into consideration the gravity of offence and also taking note of the fact that the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
