ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded judicial custody on 28.02.2023 for the offences punishable under Sections 406, 465, 471, 420, 120B IPC in Crime No.28 of 2022 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the other accused persons and the petitioner, who claimed himself as IAS officer, promised to get job for the defacto complainant's son in Railways and obtained Rs.9,00,000/- from him. Thereafter, they failed to get any job and it came to know that the petitioner herein is not IAS Officer. Hence, the defacto complainant lodged the present complaint. 3.The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he praued for bail to the petitioner. 4.The learned Government Advocate(Crl.side) appearing for the respondent strongly objected to grant bail to the petitioner stating https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD)No.8790 of 2023 that the petitioner claimed himself as an IAS officer and he along with A1 and A3 promised the defacto complainant to secure a job in Railways and obtained Rs.9,00,000/- from him and thereafter, failed to get any job. He further submits that the petitioner is also having one previous case in Cr.No.67 of 2022, which was registered for the very same allegations.

5.It is seen that the petitioner claimed himself as an IAS officer and gave false promise to get job and obtained Rs.9,00,000/- from the defacto complainant. It is also seen that the petitioner is having one previous case, which is similar in nature. Therefore, this Court is not inclined to grant bail to the petitioner.
