For Respondent : M/S.Victoria Gowri, Assistant Solicitor General of India PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. RC2292021A003/2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 120(B) Sections 7 and 8 of P.C Act, 1988 (as amended in 2018) on the file of the respondent police in Crime No.RC2292021A003 of 2021 seeks anticipatory bail.

2.The learned Assistant Solicitor General of India, appearing for the respondent police would submit that the petitioner who is working as Senior Superintendent of Regional Passport Office at Madurai, knowing very well that the persons brought by the travel agents were not eligible for issuance of Indian Passports, issued the passports after receiving gratification of more than Rs.45,000/-. The said offence had taken place during the period from June-2019 to September-2019 while he was working as the Granting Officer at Passport Seva Kendra, Tirunelveli. 3.On the earlier occasion, considering the rival submissions made by the learned counsel for the petitioner, this Court has granted interim bail to the petitioner for a period of two weeks and the petitioner was directed to appear before the respondent police daily at 10.30 a.m and 5.30 p.m and to co-operate for the investigation.

CRL OP(MD). No.10974 of 2021 4.Today, when the matter is taken up for hearing, the learned Assistant Solicitor General of India, would submit that the petitioner appeared before the respondent police only on 27.08.2021 and thereafter he did not appear and had not co-operated with the investigation.

5.The learned counsel for the petitioner would submit that the petitioner fell down in the bath room and he suffered serious injuries in his backbone and therefore, he could not appear before the respondent police and he also produced the medical certificate before the respondent police.

6. Considering the conduct of the petitioner in obtaining an order of interim protection by submitting that the petitioner was ready to co-operate with the investigation and would furnish all the details before the investigation Agency, but thereafter not appearing before the respondent police, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
