ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 465, 467, 468, 420, 120-B IPC in Crime No.109 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner is a document writer. He along with other accused created a forged document and transferred the property of the defacto complainant in the name of other accused. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD)No.10517 of 2021 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.
4.The learned counsel for the intervenor as well as the learned Government Advocate(Crl.side) appearing for the respondent police submitted that there are totally eight accused in this case and the Officials, who are working in the Sub-Registrar Office, have actively involved in the offence and hence, custodial interrogation is necessary.
5.Considering the facts and circumstances of the case and also the fact that the custodial interrogation of the petitioner is necessary in this case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
