O R D E R

This petition has been filed seeking a direction to the respondents 1 and 2 to give police protection for life and limb of the petitioner and her family members.

2. The learned counsel for the petitioner would submit that the petitioner is the owner of the property in Survey No.73/4 situated at Nanjikottai Village, Thanjavur District and because of the dispute, the third respondent, who is the sister, has filed a suit in O.S.No.101 of 2000 before the Sub Court, Thanjavur. In the meantime, the third respondent fabricated some documents and executed settlement deed in favour of the fourth respondent who is her son. The petitioner has filed O.S.No.107 of 2011 before the District Munsif, Thanjavur and pending suit, the private respondents are making trouble and hence, he sent a representation seeking police protection.

3.The learned Additional Public Prosecutor submits that based upon the complaint given by the petitioner herein enquiry has been https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.10493 of 2021 undertaken in CSR No.250 of 2021 and it came to be closed observing that it is purely a civil dispute between the brother and sister and the parties were directed to resolve the dispute in the pending suit. Since the suit is pending before the concerned court, the question of granting police protection does not arise and the parties can resolve their dispute before the civil court in the pending suit.

4. Since the representation of the petitioner was closed, nothing remains for consideration or direction in this petition and there is no question of granting police protection in the facts and circumstances of the case. Hence, this petition is disposed of.
