ORDER : The Court made the following order :- By an order dated 05.07.2022, the petitioner was directed by this Court, to hand over his mobile phone to the respondent Police. https://www.mhc.tn.gov.in/judis
2.Today, when the matter is taken up for hearing, it appears that the mobile phone was handed over to the respondent Police by the petitioner. In this regard, the learned Government Advocate (Crl.Side) submitted that no photo is available with the cell phone. However, the learned counsel for the intervener submitted that two other mobile phones are available with the petitioner. 3.Whatever it may be, today, the respondent Police has produced an order of this Court dated 09.06.2022, in Crl.O.P(MD)No.10078 of 2022, which was filed by the defacto complainant to transfer the investigation, wherein, a direction was issued to the respondent Police to arrest the accused person/petitioner herein, to take further action and to complete the investigation immediately. This Court while passing order on 05.07.2022, has not taken notice of the above said order, dated 09.06.2022.
4.Since the another Bench of this Court has already given a direction to the respondent Police to arrest the accused person, considering this anticipatory bail petition will be inappropriate, at this stage and on the sole ground, this petition deserves to be dismissed.
5.Accordingly, this Criminal Original Petition stands dismissed.
