ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 406, 420, 468 and 471 1/3
IPC in Cr.No.17 of 2023, seek anticipatory bail. 2.The case of the prosecution is that the defacto complainant invested a sum of Rs.60 Lakhs in the partnership firm and the accused persons failed to pay the returns. Apart from that, the accused persons obtained Bank loans by creating forged documents. Hence, the complaint.
3.Heard the learned counsel on either side and perused the material records of the case.
4.On a perusal of the facts and circumstances the case, even though it can be contended that the defecto complainant only invested the sum in the partnership business and the same need not be repaid. As far as the allegation regarding forgery of documents for getting the bank loan is concerned, already an expert opinion is there, which states that the signatures are not that of the de facto complainant. In view there of, this is not a fit case to grant anticipatory bail anticipated.
