*********** [Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner filed this Writ Petition to direct the respondents 1 to 3 to remove the encroachment in respect of a public pathway at S.No.150/13, Devapattu Village, Karaikudi Taluk, Sivagangai District.
2. According to the learned counsel for the fourth respondent, the land in question is a private land and as such, the petitioner has no justifiable claim in respect of the said property. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Special Government Pleader, by producing a copy of the revenue records, submitted that the land in Survey
No.150/13, Devapattu Village, is a public pathway (rh;f;fhh; nghwk;Nghf;F ghij).
4. We direct the Tahsildar, Karaikudi, Sivagangai District, the third respondent herein, to survey the land in question and remove the encroachment, in case there is any such encroachment. It is needless to point out that notice should be issued to the petitioner and the fourth respondent, before passing orders, taking into account the representation submitted by the petitioner. Such exercise shall be completed, within a period of three months from the date of receipt of a copy of this order. 5.The Writ Petition is disposed of with the above direction. No costs.
