O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Certiorari to call for the records of the proceedings of the first respondent in Ne.Mu.D3/9013/2022 dated 04.04.2024 and to quash the same.

2. The case of the petitioner is that the petitioner's father was holding patta for the land in S.F.No.41/4. Since there were mistakes in the computerised patta, the petitioner's father filed an application before the Sub-Collector, Aranthangi. The Sub-Collector conducted an enquiry and passed an order dated 23.11.2020 directing rectification of the error and deletion of the name of the fourth respondent from the computerised patta. Aggrieved by the same, the fourth respondent preferred a revision before the first respondent, namely the District Revenue Officer. The first respondent, after conducting an enquiry, passed the impugned order cancelling the patta.

3. The impugned order was passed on 04.04.2024. However, according to the learned counsel for the petitioner, the petitioner's father died on 11.01.2024. Since the person against whom the patta was cancelled was not alive when the enquiry was conducted and the impugned order was passed, the impugned order is set aside and the matter is remitted to the first respondent for fresh consideration of the revision petition, after issuing notice to all the parties, including the petitioner and the fourth respondent and to pass appropriate orders on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order.
