PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the respondents to conduct the peace committee meeting to elect the president of Chinnakottupulli Village (B group) for the period of 01.07.2025 to 31.12.2025 based on the petitioners representation dated 21.04.2025 within a time frame fixed by this Court. ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents to conduct the peace committee meeting to elect the president of Chinnakottupulli Village (B group) for the period of 01.07.2025 to 31.12.2025 based on the petitioners representation dated 21.04.2025.

2.It is seen from the records that last year the Tahsildar has conducted peace committee meeting on 12.12.2024 and elected one M.Sakthidasan as President who belongs to A Group. Now, the B Group President's chance would arise. However, the earlier President is not allowing the present petitioner to take charge as President.

3.By the above narration of facts, it is evident that the Tahsildar is not having power to conduct peace committee meeting for electing the President of a village. Therefore, the earlier peace committee meeting conducted by the Tahsildar itself is illegal and the same is quashed. The resolution passed in the earlier peace committee meeting is set aside and the entire committee is dissolved. If the village is intended to elect some committee, they should approach the competent Civil Court to establish their rights. 2/4

4.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
