PRAYER :- For Bail in Crime No.145 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners/ A2,4 and 5, who were arrested and remanded judicial custody on 14.04.2023 for the offences punishable under Sections 147,148 and 302 of IPC in Crime No.145 of 2023, on the file of the respondent police, seek bail.
2.The case of the prosecution is that there exists enmity between the family members of A1 and the deceased, due to which all the accused persons joined together and attacked the deceased and caused his death. Hence the case came to be registered. 3.The learned counsel for the petitioners submits that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He further submits that the petitioners are in judicial custody from 14.04.2023, hence he seek bail.

CRL OP(MD). No.8806 of 2023 4.The learned Additional Public Prosecutor would submit that investigation is pending and some of the accused persons are still absconding. Further investigation is still in initial stage, hence he objected to grant bail to the petitioners. 5.Taking into consideration the gravity of offence and also taking note of the fact that the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioners.
6. Hence the petition stands dismissed.
