O R D E R

This Writ Petition has been filed to issue a Writ of Mandamus, directing the respondents to permit the Villagers to conduct the festival and Valli Thirumana Nadakam scheduled to be held from 25.05.2023 to 26.05.2023 on the eve of Arulmighu Dharma Muneeshwarar Koil at Sakkathi, Pudupatti Group, Sivagangai Taluk, Sivagangai District based on the representation dated 13.05.2023 consequently to directing the respondent No.3 to provide adequate police protection in accordance with law.

2. Heard the learned counsel on either side.

3. The petitioner's request for conducting the cultural programme has not been acted upon by the respondent police, which prompted the petitioner to file the present writ petition.

4.It was submitted that already the fourth respondent has filed a writ petition in W.P.(MD).No.10537 of 2023, before this Court, wherein, an interim direction has been granted to the third respondent therein, namely the Revenue Divisional Officer, Sivagangai and the fifth respondent therein, namely the Inspector of Police, Sivagangai Taluk, jointly to conduct a peace committee 2/5

meeting in this matter by giving oppurtunity to all the parties concerned and endeavour to ensure that all the general public are granted permission to worship in the above said temple. Accordingly, the concerned Authorities conducted the peace committee meeting and passed orders permitting to conduct the festival with some conditions on 10.05.2023. Both the parties are accepted the above said orders and also gave an undertakings to conduct the festival as per the directions of the Revenue Divisional Officer. 5.In view of the above said proceedings of the Revenue Divisional Officer, the petitioner is directed to conduct the festival on 25.05.2023 to 26.05.2023, as per the proceedings of the Revenue Divisional Officer. The respondent police is also directed to give police protection. The petitioner party are also instructed not to excommunicate any of the Villagers. 6.With the above said directions, this writ petition is disposed of. No costs.
