For Respondent : Mr.M.Karunanithi, Government Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER : For Anticipatory Bail in Crime No.73 of 2026 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners/A1 to A5, who apprehend arrest at the hands of the respondent for the offences punishable under Sections 189(2), & 326(f) of BNS, 2023, in Crime No.73 of 2026 on the file of the respondent police, seek anticipatory bail.

The case of the prosecution is that due to prior enmity arising out of a family dispute involving a love marriage of a relative, the accused persons, on 08.04.2026 between 10.30 p.m. And 11.30 p.m., in front of the de-facto complainant's house at Muthukathir, formed an unlawful assembly and committed theft of his two-wheeler along with valuables kept therein, including an iPhone mobile phone, a costly pair of spectacles, and cash of Rs.4,800/-. When the same was noticed by the defacto complainant's family members, the accused persons fled from the scene. Hence, the present case.

The learned counsel for the petitioners would submit that the petitioners are innocent persons and have been falsely implicated in this case, and that they are in no way connected with the aforesaid incident. They have not committed any offence as alleged by the prosecution. Hence, he prays for the grant of anticipatory bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that there is a dispute with regard to a love marriage between the families of both parties and that there are no previous cases registered against the petitioners. However, he opposes the grant of anticipatory bail to the petitioners.

5. Heard both sides and perused the materials available on record.

Considering the rival submissions made on either side and the nature of the offences charged against the petitioners, and further considering that the alleged occurrence took place on 08.04.2026 and the First Information Report was registered on 09.04.2026, and that there is a existing dispute with regard to a love marriage between the families of 3/6

both parties, and also considering that there are no previous cases registered against the petitioners, this Court is inclined to grant anticipatory bail to the petitioners, subject to the following conditions: [a] Accordingly, the petitioners are ordered to be released on anticipatory bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruvadanai, and on further conditions that:

[b] the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders; [c] the petitioners shall not commit any offences of similar nature.

[d] the petitioners shall not abscond either during investigation or trial.

[e] the petitioners shall not tamper with evidence or witness either during investigation or trial. [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take 4/6

appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
