PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C., to call for the records pertaining to the C.C.No.335 of 2015 on the file of the District Munsif Cum Judicial Magistrate, Shencottah, Tirunelveli District and quash the proceedings as against the petitioners herein.

O R D E R

This petition is filed seeking to quash the proceedings in CC No.335 of 2015.

2.Final report has been filed by the respondent Police for the offence under Sections 326, 498(A) of IPC and Section 4 of TNPHW Act.

3.The calendar case is of the year 2015. This Court does not want to interfere with the proceedings at this stage. The presence of the petitioners 2 and 3 shall be dispensed with. The petitioners 2 and 3 shall be present before the Court below at the time of 313 questioning and at the time of passing of judgment. They shall be represented by a Counsel and they shall cross examine the witnesses on the day they are examined in chief. The petitioners shall not dispute the identity of the witnesses.

4.The first petitioner is directed to appear before the Court below during every hearing. 5.This criminal original petition is disposed of with the above direction. Consequently, connected miscellaneous petitions are closed.
