ORDER
This petition has been filed seeing for a direction to the 1st to 7th respondents herein to take suitable action as against the private respondents for excommunicating the petitioner and his family members by ensuring the fundamental rights of the petitioner within a stipulated time as fixed by this Court.

The learned counsel for the petitioner submitted that the belonged to scheduled caste and he is residing with his elder brother, namely Nagaiya and younger brother namely, Murugesu after attaining retirement on 31.05.2023. On 26.11.2026, the 8th and 9th respondents, along with the then president of Village Panchayat and certain ward members, trespassed into the house of the petitioner and with a bulldozer destroyed a portion of the petitioner's house located in the patta land in S.No.19/6B, Aadhi Dravidar Colony, Ramasamypuram in order to create a pathway for the then ward member, namely, Selvi, W/o.Loganathan and her relatives. In this regard, the petitioner's father, namely, Karuppaiah has filed a civil suit in OS No.17 of 2006 on the file of the Sub Court, Aranthangi, seeking permanent injunction as against the hooligans and he managed to obtain a permanent decree of permanent injunction from the jurisdictional civil court. on 19.10.2010.

The learned counsel for the petitioner further submitted that since the petitioner's family members were subjected to several harassment and excommunication, more particularly, they were interdicted from participating in the temple festival and compelled to do separate worship, Temple tax was refused to be received and they were also interdicted from participating in temple programs like Pongal and Mattu Pongal and barred from making any 3/7
form of purchase from shops located within the village and barred from cremating at public cremation space. In this regard, the petitioner has already sent representation to the authorities, no action was taken. Hence, this petition came to filed.
4. The learned Government Advocate, Mr.M.Sakthi kumar, submitted that the respondent police had taken sincere efforts to resolve the matter between the petitioner group and the private respondents, since the same was not resolved, this matter has been referred to the third respondent.
5. The learned Government Advocate appearing for other official respondents submitted that the matter is pending before the third respondent, and the same will be resolved. He further submitted that the decree is not in favour of the petitioner's father, but by one Nagaiya.
6. However, the learned counsel appearing for the petitioner clarified that they said Nagaiya is the petitioner's elder brother.
7. Heard the learned counsels on either side and carefully perused the materials available on record. Since no adverse order is proposed to be passed 4/7
against the private respondents, notice to them is dispensed with.

Considering the submission made by either sides, the third respondent is directed to conduct a peace committee, after issuing notice to the petitioner and the private respondents, as expeditiously as possible within a period of three weeks from today and resolve the dispute, and facilitate the petitioner from participating in all functions or in any aspect of livelihood and also make it clear that the private respondents cannot excommunicate either the petitioner or any other person in any manner in participating in any function.
9. It is made clear that even before conduct of a peace committee, the third respondent should facilitate the petitioner in participating in Chithirai festival, which is scheduled to be held on 27.04.2026 and also direct the private respondents to obtain temple tax (kudiwari) from the petitioner.
10. With the above direction, this writ petition stands disposed of. Consequently, connected miscellaneous petition is closed. 22.04.2026 NCC : Yes / No Index : Yes / No sm Note: Issue order copy on 24.04.2026.
