For Respondent : Mr.T.Senthilkumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail Crime No.20 of 2017 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners/Accused 2 & 5, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 420, 465, 468, 471, in Crime No.20 of 2017 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the petitioners and other accused, who are the legal heirs of Ramiah Thevar sold the disputed property in favour of A6 by suppressing the earlier gift executed by Ramiah Thevar in favour of one Murugan. Hence, the complaint was lodged against the petitioners and other accused. 3.The learned counsel for the petitioner submits that this petitioner was granted anticipatory bail by the Court of Sessions and this petitioner has gone to North India and therefore, he could not execute the sureties in the earlier anticipatory bail. CRL OP(MD). No.10539 of 2021 filed. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
4.Accordingly, this criminal original petition is dismissed with liberty to the petitioner to file a fresh application along with all details.
