PRAYER: Criminal Revision Case filed under Section 397 r/w 401 of Cr.P.C., praying to call for the records relating to the order passed in Cr.M.P.No.3122 of 2023 in C.C.No.42 of 2020 on the file of the learned Judicial Magistrate, Tenkasi and set aside the order dated 28.04.2023 and allow the Criminal Revision Petition.

ORDER

This petition has been filed challenging the order dated 28.04.2023 passed in Cr.M.P.No.3122 of 2023 in C.C.No.42 of 2020 on the file of the learned Judicial Magistrate, Tenkasi.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondent.

3. On perusal of the records and considering the submissions made on either side, this Court finds no reason to interfere with the order of the learned Judicial Magistrate, Tenkasi, declining the petition seeking for the relief of cancellation of warrant issued against the petitioner. However, the petitioner shall surrender before the trial Court and on such surrender, the trial Court shall recall the warrant on merits directing the petitioner to appear before the trial Court, as and when required for interrogation.
