Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 2nd respondent to dispose of the appeal filed by the writ petitioner, dated 22.06.2024, and received by 2nd respondent on 26.06.2024 in respect of lands in S.No.431/3, Manamadurai.

ORDER

The petitioner herein seeks a direction to the 2nd respondent to dispose of the appeal filed by him, dated 22.06.2024, in respect of the patta transfer order, concerning the lands in Survey No.431/3 in Manamadurai.

2. According to the petitioner, 0.35 cents of land situate in Survey No.431/3 in Manamadurai Town belongs to the petitioner temple and patta for the same has been wrongly issued in favour of six persons, namely, Meena and others. Therefore, the petitioner submitted a representation before the second respondent on 22.06.2024, seeking cancellation of patta issued in the names of the private individuals and restoration of the same to the petitioner temple. Since the said representation has not been considered, the petitioner has come forward before this Court by way of this Writ Petition.

When the matter is taken up for hearing, Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondents, would submit that the appeal filed by the petitioner, dated 22.06.2024, will be considered by the second respondent on its own merits within a time stipulated by this Court.

4. In view of the above submission made by the learned Government Advocate, without going into the merits of the claim made by the petitioner, the second respondent is directed to consider the appeal filed by the petitioner, dated 22.06.2024, and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of copy of this order, after affording reasonable opportunity to the petitioner and also the private individuals, in whose names patta has already been issued.

5. Writ Petition is disposed of accordingly. No costs. 02.06.2025 NCC :
