PRAYER :- For Bail in Crime No.77 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 26.04.2022 for the offence under section 8(c) r/w 20(b)(ii)(C)of NDPS Act in Crime No.77 of 2022 on the file of the respondent police seeks bail.

2.The case of the prosecution is that on 26.04.2022, the respondent police conducted a raid and intercepted the petitioner. On search, it was found that the petitioner was in illegal possession of 30.500 kgs of ganja. Hence the case. 1/3

3.Heard both sides and perused the materials available on record including the First Information Report. 6.It is seen that the petitioner was found in illegal possession of 30.500 kgs of ganja, which is commercial quantity. That apart, the petitioner involved in 8 previous cases, which are similar in nature. Hence, the petitioner failed to fulfill the twin conditions as contemplated under Section 37 of NDPS Act. Therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed. However, the trial Court is directed to complete the trial in C.C.No.220 of 2022, within a period of six months from the date of receipt of a copy of this order.
