ORDER
This Criminal Original Petition is filed to direct the Principal District & Sessions Judge (Special Court for SC/ST (PA) Act Cases), Pudukottai to consider the petitioners' bail application on the same day of his surrender in Crime No.120 of 2021 on the file of the Inspector of Police, Namasamudram Police Station, Pudukottai District.
2. When the matter taken up for hearing on 20.07.2021, the learned Additional Public Prosecutor would submit that insofar as the first respondent is concerned Crime No.13 of 2019 for the https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.10552 of 2021 offences punishable under Sections 147, 148, 294(b), 323, 324 and 506 (ii) IPC is pending for trial. Insofar as the second petitioner is concerned, a case in Crime No.37 of 2014 for the offences punishable under Sections 294 (b), 323 and 506 (ii) IPC is pending. Insofar as the third petitioner is concerned, no case is pending. Injured person is still in Government Medical College Hospital, Pudukottai.
3. The learned counsel for the third respondent would submit that there is a repeated trouble by the petitioners and now, he is taking treatment.
4. Since the victim is taking treatment in the hospital, a direction will not arise for considering the application of the petitioners and no such direction, can be issued. Considering the present position, this Criminal Original Petition is dismissed.
5. Even though, Mr.A.Shajahan, learned counsel, filed Vakalat for the third respondent, he is being juvenile, no Valakat can be filed. But, however, his submission is also placed on record.
